中国档案行政监管的历史演进和内涵扩展——基于法规文本的分析

摘要

档案行政监管是提升档案治理能力和法治水平的重要手段。在档案行政监管不断受到重视的背景下，基于依法行政和历史主义视角，采用文本分析法和比较研究法，对相关档案法律法规进行梳理分析，进而总结中国档案行政监管的历史演进和内涵扩展。研究结论表明：中国档案行政监管的历史演进经历了四个发展阶段，即监管引入和奠基阶段、监管体系全面建立阶段、监管优化和扩展阶段、监管重构和升级阶段；其内涵扩展体现为四个方面，即监管目的与时俱进、监管主体更加明确、监管内容不断丰富、监管手段走向多样。文章最后对中国档案行政监管的未来走向进行了展望。

Abstract

Archives administrative regulation is an important means to improve the ability of archives governance and the level of rule of law. Under the background of continuous attention to archives administrative regulation, based on the perspective of administration according to law and historicism, this paper adopts the methods of policy analysis and comparative research to analyze the text of relevant archives laws and regulations, and then summarizes the historical evolution and connotation expansion of archives administrative regulation in China. It concludes that the historical evolution of archives administrative regulation in China has experienced four development stages: the introduction and foundation stage of regulation, the comprehensive establishment stage of regulation system, the optimization and expansion stage of regulation and the reconstruction and upgrading stage of regulation. Its connotation expansion is reflected in four aspects: the purpose of regulation keeps pace with the times, the subject of regulation is clearer, the content of regulation continues to be enriched and the means of regulation tends to be diversified. It also looks forward to the future trend of archives administrative regulation in China.
